XENIA — A man said to be in the United States illegally was sentenced Tuesday to 10 years in prison for raping a child.

Fidel Aguilar, 42, pleaded guilty to a count of rape (with no age specification) and a count of attempted rape and was sentenced for the two charges Tuesday in Greene County Common Pleas Court. Judge Stephen Wolaver sentenced Aguilar to 10 years for the first count and eight years for the second count, to be served concurrently.

Beavercreek Police Captain Eric Grile described Aguilar as an “illegal immigrant,” who was living at his employer’s house. Grile said police were called to the house at 4 a.m. June 17, by the resident who had “awoken … to find Mr. Aguilar sexually assaulting his two daughters (ages 9 and 12).”

Aguilar pleaded guilty to the two charges in a plea agreement Tuesday after two charges of child rape, one charge of attempted rape and one charge of attempted gross sexual imposition were dismissed. The original two counts of child rape both carried a potential penalty of life in prison.

Aguilar was also ordered to register as a Tier III sex offender.

“It was one of those cases you don’t want to have,” Grile said. “It is what it appears.”

Grile said police assume that Aguilar would be deported from the U.S. following his prison sentence.

Wolaver ruled in January that incriminating statements Aguilar made in an interview with the Beavercreek Police Department in June of 2015 were inadmissible due to how a detective and an interpreter handled the interview.

In a court document, Aguilar’s attorney Randall Stump described his client as a Mexican citizen “who has only been in this country for a few months,” and wrote that Aguilar speaks no English.

A request for comment from Stump was not returned as of press time.
